Although I live and play in Atlanta, I feel certain that anyone attending an “adult oriented or adult themed” party has encountered some type of release form. In Atlanta they are widely used in both private clubs and residences hosting any sort of adult party encompassing anything from BDSM to swinging.

These releases normally want your true and legal name, age, and a declaration that you are not a member or agent of any law enforcement agency along with any other information the individual promoter or host requires.

Without talking in absolutes or completely laying out a release, I thought I speak about releases in general terms.

When drafting a release one needs to think about the kinds of information he wishes to elicit from his guests? Depending on your state of residence the age of the attendee may be relevant; generally in Atlanta most of the releases I’ve encountered require an attendee to be Twenty-one (21) years of age or older.

You may wish to attach a copy of valid government issued identification as well the attendee’s true and correct name. Perhaps an address if you are keeping records which may allow you to generate invitations for future parties. Although unless you as the host can guarantee the security of private information I would strongly advise a host to keep track of their guests; think Heidi Fleiss, her record keeping proved to be a treasure trove for prosecutors.

You may also want a statement questioning whether an attendee is employed by law enforcement agency and acting in an official capacity at the time or an agent of a law enforcement agency acting in an official capacity while in attendance. And, yes I do understand an individual may lie but having a signed document my ward off legal problems later. You might also want to make sure an attendee isn’t a working journalist or freelancer working a story.

For a release involving BDSM activities a statement attesting to the consensual and voluntary participation is useful. As is any medical conditions that could become serious in an emergency.

Of course an adult release can be as complicated or as simple as the individual hosts wishes to make his. Just remember before drafting your release have an idea of what information you want and how you plant to either store or use the information you collect.
