Britain’s Supreme Court has ruled that homosexuality may be used as a reason for seeking asylum in the United Kingdom. The ruling underscored that the right of a homosexual individual to be themselves or not to have to deny their sexuality is a fundamental right. Read the rest of this entry »

It sickens me reading all the absurd opinions wafting out of Hollywood regarding Roman Polanski that attempt to justify his behavior, downplay his actions or to even say that because of his age, the fact that he’s married and has grandchildren hes not a danger. WTF?

I’m an Assistant District Attorney and I take my job seriously. I relish the responsibility I have in helping to keep my community and State a safer place. In fact many times I zealously cases that I find especially egregious. Something that I feel very strongly about are case involving child molestation, child exploitation and child pornography. But the article below borders on the absurd; a prosecutor using his position to advance a private agenda. Hopefully the 3rd Circuit Court of Appeals will see this case for what it is, egregious grandstand by an ambitious and over zealous individual. Read the rest of this entry »

Roman Polanski is sitting in a Swiss jail awaiting news of whether or not he will be extradited to the United States to finally be sentenced on a felony sexual offense. Although Polanski plead guilty to having sex with a minor, Hollywood talking heads seem to believe he shouldn’t be punished. Its seems providing alcohol and drugs to a thirteen year old girl and then having sex with her isn’t a big deal, no matter that she said no, or that she was under the age of consent or that she was also under the influence of both alcohol and drugs. Since Polanski is such a brilliant and sensitive artist the justice system should turn a blind eye and let bygones be bygones.

Just to put this into perspective if this incident had occurred in Georgia for example, Polanski would have been facing a mandatory twenty (20) year prison term, and because multiple acts occurred conceivably he could have been sentenced to consecutive prison terms for each act. But Polanski fled the county before he could be sentenced.

“…[M]ovie mogul Harvey Weinstein, who has been circulating the pro-Polanski petition, wrote in an op-ed in the Independent, a London newspaper, that ‘whatever you think about the so-called crime, Polanski has served his time. A deal was made with the judge, and the deal is not being honored. . . . This is the government of the United States not giving its word and recanting on a deal, and it is the government acting irresponsibly and criminally.”‘

Apparently only telling part of the truth is acceptable in Hollywood, which is what Harvey Weinstein has done. Weinstein alludes that the United States is reneging on a deal, which isn’t correct. Polanski plead guilty, a recommendation for sentencing was placed before the trial judge for consideration. While the judge was considering whether or not to accept the sentencing recommendation Polanski was ordered to undergo a psychological exam. When it became known to Polanski prior to sentencing that the Judge might not accept the plea he fled the country.

Weinstein must have forgotten in his haste to thump his chest in outrage, that ANY plea agreement is always subject to approval by the presiding judge. A judge isn’t bound to accept any plea, and may change it in any way they see fit. Now Polanski could have withdrawn his guilty plea at that point and proceeded to trial, but he chose to flee.

Another Hollywood mouthpiece who has weighed in offering her enlightened opinion is “…[A]ctress, comedian and “The View” co-host Whoopi Goldberg [who] has come under well-justified fire for making a jaw-dropping statement about Polanski’s crime: ‘I know it wasn’t rape-rape. I think it was something else, but I don’t believe it was rape-rape.”‘

Actually it was “rape-rape”, unless “NO” has an alternate definition in the State of California; or in California its OK to have sex with underage girls if your a celebrity; or its OK to have non-consensual sex with an underage girl who you have plied with alcohol and drugs.

I hope the Swiss authorities stick to their guns and extradite Polanski back to the United States allowing the justice system to work as intended. Polanski should be jailed, but the sad truth is that he probably won’t serve any significant time. All because of who he is and who he knows, sadly justice isn’t blind and has shown time and time again how star struck she can be.

Credentials

Some readers may notice that I have edited my information, sadly I have been forced to this decision by personal circumstances.

I’m an attorney licensed in the State of Georgia and have been actively practicing since 1997, exclusively in the area of criminal law. Currently I’m an Assistant District Attorney working in a small rural judicial circuit.

Also, I am profoundly dyslexic (so get past any imperfections in language) and clinically depressed.
